Muslim Brotherhood Legal Committee: Classifying Group as Terrorist Legally Null and Void
Egypt legal experts assert that the military-installed government’s baseless decision to classify the Muslim Brotherhood as a terrorist organization violates the law.
Friday, December 27,2013 06:32

A leading member of the Muslim Brotherhood’s Legal Committee in Egypt – who requested anonymity – said: "Naming the group a terrorist organization is null and void, totally illegal.

"This classification came without investigation, without evidence... No entity should be so classified or disbanded, except through legal procedures. Thus naming the Muslim Brotherhood a terrorist organization is completely groundless in the absence of any evidence to prove this description which is vehemently rejected by the group."

He added, "Furthermore, the decision is invalid and illegal, because so far no court made any definitive judgments about the group and its leaders.

"The Brotherhood’s Legal Committee is considering an appeal of this decision. It will announce its course of action and legal position later."

Furthermore, head of Tanta Court of Appeals, judge Walid el Shaf'i, stated that cabinet's decision designating Muslim Brotherhood as terrorist organization is legally null and void and will be thrawn out by court if challenged.  He added that Article 86 of the Penal Law, which Cabinet relied on in its decision,  can only be enforced by a court order not by an excutive decision.

Earlier on Wednesday, the Egyptian government announced that the Muslim Brotherhood is a "terrorist group", following the death of 16 people in a bombing of the Security Directorate headquarters in Dakahlia Governorate (76 miles northwest of Cairo).

In the meantime, a statement from a militant group calling itself Ansar Beit Al-Maqdis (Supporters of Jerusalem), one of the armed militant groups in the Sinai Peninsula, on Wednesday evening, claimed responsibility for the bombing, which targeted Dakahlia’s Security Directorate building.
